Paul F. Matousek

Biography
Paul Matousek has more than 22 years of experience representing U.S. and international insurers and others in matters involving directors and officers liability (D&O), other professional liability, errors and omissions (E&O), employment practices liability (EPL) and corporate indemnification. He has dealt with companies ranging from the Fortune 50 (including financial institutions) to nonprofits, as well as major law and accounting firms. Paul has been named one of the Illinois “Super Lawyers” for 2008, 2009 and 2010.
Paul handles all aspects of claims and litigation assessment, management and resolution – with extensive experience in alternative dispute resolution – applying legal, practical and business considerations. He is regularly retained in connection with securities and ERISA class actions, shareholder derivative actions, regulatory and criminal proceedings, complex business disputes and other high-exposure situations, along with related insurance coverage issues. For example, Paul has been involved recently with a number of major matters, including litigation concerning the credit and subprime mortgage crisis (e.g., Lehman Brothers), options backdating, contingent commissions, initial public offering laddering and mutual funds market timing/late trading, as well as litigation involving JDS Uniphase (one of the few securities class actions to be tried to verdict), Enron, Refco, Merck, Boeing, W.R. Grace, Intel, Baxter International, Lucent Technologies, TXU, Honeywell International, Bank of America, El Paso, Lockheed Martin, Royal Dutch Shell and Aquila.
In addition, Paul consults on insurance risk analysis, underwriting issues and policy drafting. He also has litigated significant coverage actions in numerous federal and state courts across the country on behalf of U.S. and international insurers, and has experience in commercial litigation as well. Paul has written and spoken on numerous topics concerning D&O, other professional liability and E&O, as well as insurance and indemnification issues generally.
